General Terms and Conditions of TRIXX Studios for the Rental of Recording Studios

The following terms and conditions become part of the contract upon placement of the order, unless otherwise agreed in writing. In the following, "TRIXX Studios" or "Lessor" refers to the studio, and "Client" or "Lessee" to the renting party.

The Client (Lessee) or their authorized representative (Producer) is obligated to adhere to the agreed start and end times of the recording sessions. There is no entitlement to use the studio rooms beyond the agreed time.
If confirmed bookings are not kept, we reserve the right to charge downtime at 50% of our listed rates, provided that the time slot could not be filled with other bookings.

Billing is based on the recording report and the current price list. The Lessee must specify in advance who is authorized to sign and verify the recording report on their behalf. The report will be presented to the Client or Producer for signature at the end of each working day. By signing, they acknowledge the accuracy of the recorded working hours, material usage, and the technically satisfactory quality of the recordings. Later complaints will not be accepted.

Breaks exceeding one hour per recording day will be fully charged. Started hours will be rounded up to the next half or full hour.
Telephone calls will be billed according to the price list. The Producer is liable for all calls made from telephones located in the rented rooms.

Downtime caused by equipment malfunction during the rental period will not be charged to the Lessee. However, TRIXX Studios shall not be liable for any resulting damages or costs. TRIXX Studios is only liable for intent or gross negligence on the part of its personnel. The Studios assume no liability for any items that do not belong to them, and they do not provide insurance coverage for such items. This explicitly includes all types of sound carriers handed over to the Lessor for storage or safekeeping in its archives.

The Lessee is liable for any material or personal damages arising in connection with persons or guests involved in the production. TRIXX Studios is released from any liability for damages sustained by visitors or persons involved in the production within the premises or on the studio grounds.

The Lessor retains full authority over the premises ("house rules") at all times, even during the rental period.
The Lessee must make an advance payment at the start of production amounting to approximately 50% of the expected studio costs. The total invoice amount is due immediately upon receipt, without deductions. The Lessor is entitled to retain the recordings until full payment has been received.

If items are shipped or transported elsewhere at the Producer’s request, this will always be done at the Producer’s expense and risk.

Place of performance and jurisdiction is Berlin.
